1. Acceptance of Terms

By accessing or using the Insider Pass website, wallet passes, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these terms at any time. If we make material changes, we will notify you through the Service or by other means. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Services & Access

Insider Pass provides a platform for brands to create, manage, and distribute digital wallet passes (Apple Wallet and Google Wallet) to their customers. The Service includes features for push notifications, geolocation-based alerts, and loyalty program management.

2.1 Availability

We strive to keep the Service available 24/7, but we cannot guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, upgrades, or other reasons.

2.2 API Usage

If you access our Service via API, you agree to comply with our API usage guidelines. Excessive or abusive usage of the API may result in temporary or permanent suspension of your access.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

• You are responsible for safeguarding your password.
• You agree not to disclose your password to any third party.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Fees and Payment

Some aspects of the Service are provided for a fee. You agree to pay all applicable fees related to your use of the Service.

Subscriptions: Service is billed in advance on a monthly or annual basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Insider Pass and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

You retain all rights to the data and content you upload to the Service ("User Content"). By uploading User Content, you grant Insider Pass a license to use, store, and display your User Content solely as necessary to provide the Service.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

7. Limitation of Liability

In no event shall Insider Pass, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
